Our TERMS OF USE constitute a legally binding agreement between the user and Dialog Audio.
Please read these TERMS OF USE carefully. We expect user to take these guidelines seriously.
Dialog Audio reserves the right to remove any content deemed to violate our TERMS OF USE at our discretion.
Copyright
Dialog Audio does not take any responsibility for any (music, images, etc.) copyright infringement of its users. Only the user is responsible for all activity associated with its account. If the user uploads or broadcasts content that belongs to someone else, or if user uploads or broadcasts someone else’s content (also in a remix), user has to make sure that it has the permission of all related rights holders. Content that is being broadcasted without permissions will be removed and the connected account terminated.
User is not allowed to use someone else’s name, brand or identity without their permission, or to pretend to be someone else.
Unauthorized recording or publishing of private information
The sharing of personal details of others, without their permission is not allowed. This includes recordings of private conversations, full names, images, addresses or phone numbers.
General rules
It’s not allowed to upload or broadcast
User confirms that they is either more than 18 years of age, or an emancipated minor, or possesses legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.
Furthermore user agrees to be bound by the terms of use of media or social network websites by connecting its media or social network platforms accounts (Facebook, YouTube, Instagram, Twitch and so forth) to our service.
By using this service or broadcast software, user agrees to such processing and warrants that all data provided is true, correct and accurate.
User agrees to proactively register its event at the relevant Performance Rights Organization (PRO). In no event is Thats Live/Dialog Audio liable for any omission in connection with user’s obligations towards PROs.
Termination of accounts
If we believe that illegal or non-compliant activities are taking place on the user account, we reserve the right to terminate its account immediately, without prior warning.
Privacy on Dialog Audio
At Dialog Audio, your privacy is important to us. Please read our privacy and cookie policy carefully.
Information provided by user
If the user makes inquiries to us, we will collect their names and email addresses and only information it submits.
If the user wants to access or delete any personal information we hold, or if they have any objection to the processing of this information, they are invited to contact us.
Modification of these TERMS OF USE
We reserve the right, to modify parts of these TERMS OF USE at any time. If so, we will provide you notice of these changes.
Billing
As the customer, user is responsible for all applicable taxes. Dialog Audio will collect taxes when required by law to do so.
Dialog Audio is not responsible for any bank fees or commissions.
Cancellation policy
Within the first 7 calendar days of activating a paid account, user may cancel its subscription. Please contact the support team to get a refund. If user cancels within the first 7 calendar days, the paid plan will be cancelled, including access to the features available through the related account.
After 7 calendar days, paid subscriptions are no longer refundable.
Warranties / Liability
The services provided by Dialog Audio are provides "as is" and without warranty or condition. As with all online services, Dialog Audio is occasionally subject to outages or other interruptions in service. Problems may at times be due to reasons beyond Dialog Audios control. Dialog Audio will not under any circumstances be liable for any losses suffered on users part as a consequence of an interruption in service. We will not be held liable if, for any reason, the Dialog Audio service is unavailable at any time or for any period. We may at our sole discretion, and without notice, restrict access for a period of time to all or part of the website or Dialog Audio service.
Indemnity
User hereby indemnifies us and undertake to keep us fully and effectively indemnified from and against any and all third party claims, losses, damages, actions, costs and liabilities incurred or suffered by us as a result of, in connection with or arising out of: (1.) any breach of warranty, representation or covenant made by the user; (2.) any infringement of intellectual property rights of any third party in connection with customers use of the Dialog Audio site and its service.
Law and jurisdiction
These TERMS OF USE will be governed by and construed in accordance with German law, and any disputes relating to these terms of use will be subject to the exclusive jurisdiction of the courts of Germany.
